RC Raceway of Uniontown, OH is closing its doors over liability concerns.

The decision stems from an incident on January 15, when an RC car driven by a minor went airborne and veered outside of the racing surface, striking a man who suffered a broken arm.

The owner of the facility, Chris Holmes, said the plaintiff filed a claim with the insurance company for the track. Holmes was contacted by an attorney on behalf of the plaintiff, who asked for information about Holmes, his business, and the incident, but also about the driver of the vehicle and his parents. Though he had not yet been told of any dollar amount, Holmes said that the insurance company warned him that in many cases when a plaintiff retains an attorney they often seek more than just medical expenses.

That prompted Holmes to make the decision to close the track as a preventative measure.

"Knowing that the driver of the car could also be sued, I just don't want any part of that," said Holmes, who required every racer entering the facility to sign a waiver. He said he had 95 waivers signed by the plaintiff, whom he allowed to race for free in exchange for working on the track.

"This is a very hard thing for me to do because I am a racer and I love doing this," said Holmes, "but it's just not worth all the work, worry and frustration with no compensation and then to have this happen."

Holmes said that racers in the local area will be meeting at the track, located at 142 Lincoln Park in Hartville, OH, at 6:00 PM to discuss forming a not-for-profit club in order to keep the track available for racing. Anyone interested in helping to organize the club is invited to attend.
